Title Search
The title search is the process of investigating a land title to make sure the holder is a legal vendor; that is, there are no restrictions on ownership or encumbrances to the sale. This usually includes the examination of public documents, court decisions, and other records within a given number of years. The title search is usually performed by a conveyancer, solicitor, or a licensed examiner from the buyer's party, with the costs usually shouldered by the buyer. Common encumbrances found in titles are outstanding loans, unpaid taxes, liens, and ownership restrictions.
